1. How these terms work
These terms apply when Highway supplies a website, domain name, website hosting, hosted email or a related service. They form part of our Customer Terms. Your quote or written service description sets out the particular work, inclusions, price and billing cycle. If it says something different, the specific written term takes priority.
2. Quotes, scope and changes
A website quote covers the pages, functions, content and services described in it. New features, substantial design changes, additional pages, content entry, photography, copywriting or other work outside that scope may be quoted separately. We will discuss additional charges before carrying out work that is not included.
Unless ongoing maintenance is included in writing, website hosting does not include unlimited content changes, redesigns or software work.
3. Website ownership
Once the website project has been paid for in full, you own the website design and original work Highway created specifically for you. Your own text, photographs, logos and other material remain yours.
Third-party software, WordPress, themes, plugins, fonts, stock images and other licensed material remain subject to their own licences. We cannot transfer ownership of something neither you nor Highway owns, but we will explain any relevant licence or ongoing cost.
If you want to manage the website yourself, we can provide reasonable administrator access and show you the basics. You are not required to keep using Highway simply to retain control of a website you have paid for.
4. Your content and instructions
You are responsible for checking and approving content before publication and for making sure material you provide is accurate, lawful and does not infringe another person’s copyright, privacy or other rights. We may decline or remove material where we reasonably believe it is unlawful, harmful or creates a serious security risk.
5. Domain names
Where Highway registers or manages a domain for you, we will record the customer or their nominated organisation as the registrant wherever the registry rules permit. The domain is yours to use while it remains registered and you meet the applicable eligibility and registry requirements.
Please keep registrant and contact details current. Domain registrations and renewals are submitted to third-party registries and are generally non-refundable once processed. If a domain expires, recovery may not be possible and registry restoration fees may apply.
You may transfer a domain away from Highway. We will provide the information reasonably required for the transfer once identity and authority have been verified and the relevant account is paid.
6. Hosting and hosted email
Hosting provides space and resources on systems operated by Highway or our suppliers. Hosted email is subject to mailbox limits, security controls and our Acceptable Use Policy. Spam and malware filtering reduce risk but cannot guarantee that every unwanted message is blocked or every legitimate message is delivered.
Service availability can be affected by maintenance, software faults, cyber incidents, upstream suppliers and events outside our reasonable control. We will take reasonable care and work to restore a service when something goes wrong.
7. Security, passwords and updates
We take reasonable steps to protect services we manage. You must protect passwords, use access only for authorised people and tell us promptly if you suspect an account or website has been compromised. If you or another provider make changes, install software or disclose credentials, Highway is not responsible for problems caused by those actions, but we can help investigate and repair them as separately agreed work.
8. Backups
We may maintain operational backups for disaster recovery, but they are not a guaranteed archive or substitute for keeping your own copies of important content, business records and email. Before cancelling or moving a service, arrange any export or backup you need.
9. Fees and billing
Website projects are billed as set out in the quote. Hosting is normally billed quarterly, or monthly when it is combined with other Highway services. Domain registration, software licences and other third-party costs may be billed in advance. Invoices are due within 14 days unless we agree otherwise.
10. Cancelling or moving
You may cancel by telephone or email, although email is preferred so both of us have a written record. Hosting, domain-management and hosted-email services continue until the end of the already-paid billing period unless we agree to an earlier date. Fees already paid are not normally refundable.
We will reasonably assist with a move and provide available website files, content, domain-transfer details or account information after verifying authority and payment. Migration work, specialist exports or work required by the new provider may be charged if it falls outside ordinary handover.
Please arrange the handover before the service ends. Data may be deleted after cancellation and should not be treated as recoverable once the service has closed.
11. Suspension and termination
Where practical, we will contact you before restricting a service. We may act urgently where necessary to address unlawful activity, malware, a serious security threat, harm to other systems or a legal requirement. Overdue accounts are handled under our Customer Terms and payment-assistance obligations.
12. Consumer rights and contact
Nothing in these terms excludes a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. Contact Highway on 02 6372 3645 or admin@hwy.com.au if you have a question or want to arrange a handover.
