1. Who this policy applies to
This policy applies whenever you use a telecommunications, internet, email, hosting or related service supplied by Highway Internet Services. It forms part of our Customer Terms.
You are responsible for activity using your service or account, including activity by family members, staff, visitors and other people you allow to use it. You should take reasonable steps to secure your equipment, accounts and passwords.
2. Lawful and responsible use
You must use the service lawfully and with reasonable regard for other people, their rights and the security and performance of networks and systems. You must also comply with reasonable conditions that apply to any third-party network, platform or service you access.
3. Prohibited activity
You must not use, attempt to use or allow the service to be used to:
- break any applicable Australian or international law;
- infringe copyright, trade marks, privacy, confidentiality or other legal rights;
- commit fraud, impersonate another person or organisation, or send deceptive or misleading communications;
- harass, threaten, stalk, defame or abuse another person;
- access or attempt to access an account, device, system, network or data without authority;
- damage, alter, delete or interfere with another person’s systems, files, credentials or data;
- create, distribute or facilitate malware, ransomware, viruses, worms, botnets, phishing, denial-of-service attacks or other malicious activity;
- send spam or unsolicited commercial electronic messages contrary to applicable law;
- distribute unlawful content or material, or content you do not have the right to distribute;
- interfere with the operation, security or normal use of a service or network; or
- resell or provide the service to others as a commercial service without Highway’s written agreement.
4. Network and service protection
You must not generate traffic or use resources in a way that unreasonably degrades a service, threatens network security or prevents other customers from using services normally. Ordinary high-volume use of an unlimited internet plan is not, by itself, a breach. Our concern is activity that is harmful, unlawful, malicious or creates an unreasonable operational risk.
If we reasonably believe that a device or account has been compromised, we may ask you to take steps such as changing a password, updating software, removing malware or temporarily disconnecting affected equipment.
5. What Highway may do
We do not routinely inspect the content of your internet traffic. However, we may investigate information reasonably available to us when we receive a credible complaint, detect a security or network threat, need to troubleshoot a service, or are required to do so by law.
Where practical and safe, we will try to contact you and give you an opportunity to address the problem before restricting a service. We may act immediately where necessary to prevent serious harm, protect a network or customer, respond to an emergency, comply with law or a lawful direction, or stop clearly unlawful or malicious activity.
Depending on the circumstances, we may warn you, ask you to stop or correct the activity, temporarily restrict or suspend the affected service, remove unlawful or harmful material hosted on systems we control, or cancel the service in accordance with our Customer Terms and applicable law.
6. Restoring a service
If a service has been restricted or suspended and the cause has been resolved, we will restore it as soon as reasonably practical unless the breach is serious, repeated or the service has been lawfully cancelled.
